Publication note: The governing-law and dispute-resolution fields in Section 16 must be completed by the company before these terms are published. This template is not a substitute for advice from a lawyer familiar with the markets where the service will be offered.
1. Acceptance of these terms
By downloading, installing, registering for or using ComfiCare, you acknowledge that you have read and agree to these Terms of Service and the ComfiCare Privacy Policy. If you do not agree, do not use the service.
2. Eligibility and account
You must be at least 18 years old and legally capable of entering into a contract to create a caregiver account. You must provide accurate information and protect your password, multi-factor authentication devices and pairing information. You are responsible for activity under your account. If you suspect unauthorized access, change your password and contact support@comficare.co promptly.
3. The service
ComfiCare provides features such as schedules and reminders, photo display, text-to-speech, device pairing, care-status prompts and privacy/data-management tools. Some features depend on internet access, device notification permissions, battery status and third-party services.
4. Medical disclaimer and emergencies
ComfiCare is an auxiliary care tool, not a medical device. It does not provide medical diagnosis, treatment advice, clinical assessment, medication decisions or emergency response. Use of the service does not create a doctor-patient, nurse-patient or other professional healthcare relationship.
If a care recipient experiences sudden confusion, unusual behavior, a risk of self-harm or harm to others, or any situation requiring immediate medical attention, contact a healthcare professional or local emergency services immediately. Do not rely on ComfiCare for emergencies.
5. Caregiver responsibilities
You confirm that:
- You have authority to enter and manage the care recipient’s information.
- You have explained the service to the care recipient or their legal representative and obtained any required authorization.
- You will verify reminders, schedules, medication-related information and card content for accuracy.
- You will not use ComfiCare as the sole means of care, supervision or emergency response.
- Photos, text and other content you upload do not violate another person’s privacy, intellectual property or other rights.
Care decisions should be made by the caregiver, care recipient and relevant healthcare professionals based on the circumstances.
6. Acceptable use
You must not:
- Access another person’s account, household, device or data without authorization.
- Use the service to monitor, track or harass someone who has not consented.
- Upload illegal, harmful, abusive, fraudulent or rights-infringing content.
- Upload identity documents, medical records, financial information or other sensitive information that is not necessary for the service.
- Reverse engineer, bypass security controls, disrupt the service or attempt to access unauthorized data.
- Resell, rent or use the service for unlawful commercial purposes.
- Use automated means to scrape data at scale or interfere with the service.
7. User content
You retain your rights in content you upload. To provide, sync, display, back up and process that content as part of the service, you grant us a limited, non-exclusive and revocable license to use it only as necessary to provide the service.
Card cover images may be accessible through links. Do not upload images you do not want someone with the link to see. You must have the legal rights needed to upload and use your photos and text.
8. Privacy
We process personal information as described in the ComfiCare Privacy Policy. By using the service, you acknowledge the data practices described there. Where separate consent is required by law, we will obtain it separately.
9. Third-party services
The service may rely on providers such as Supabase, PowerSync, Expo and Resend, as well as Apple App Store, Google Play and device functions such as notifications, text-to-speech and camera access. Third-party services may be subject to their own terms and privacy policies. We are not responsible for services independently provided by third parties, but will provide reasonable assistance with related issues.
10. Fees
As of this version of these terms, in-app auto-renewing subscriptions are not enabled. If paid features are introduced in the future, we will display the price, billing period, renewal and cancellation terms before purchase. Purchases made through Apple or Google are also subject to the applicable app-store payment and refund rules.
11. Intellectual property
The ComfiCare name, logo, software, interface, text and other materials we provide are protected by intellectual property laws. Unless expressly permitted, you may not copy, modify, distribute, sell or use them for commercial development. We grant you a personal, non-commercial, non-transferable license to use the service in accordance with these terms.
12. Service availability and changes
We will make reasonable efforts to maintain the service, but do not guarantee that it will always be uninterrupted, error-free or suitable for your particular needs. A device being powered off, network interruptions, system notification restrictions, depleted battery, third-party outages or failure to check notifications may cause reminders to be delayed or missed. We may modify, suspend or discontinue features for maintenance, security, compliance or product changes.
13. Disclaimer of warranties
To the maximum extent permitted by law, the service is provided “as is” and “as available.” We disclaim express or implied warranties of merchantability, fitness for a particular purpose, non-infringement and uninterrupted service. Nothing in these terms excludes consumer rights that cannot legally be excluded.
14. Limitation of liability
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, punitive or consequential losses arising from use of, or inability to use, the service, including missed reminders, delays in care, data loss or third-party service failures.
These limitations do not apply where prohibited by law. To the extent permitted by law, our total aggregate liability for the service will not exceed the amount you actually paid for the service during the preceding 12 months. If the service is free, liability is limited to the minimum extent permitted by law.
15. Suspension and termination
We may suspend or terminate your account if you violate these terms, endanger others, infringe another person’s rights or create a security risk. You may stop using the service and request data deletion through in-app privacy controls or by contacting support. After termination, data handling remains subject to the ComfiCare Privacy Policy.
16. Governing law and disputes
[TO BE COMPLETED BEFORE PUBLICATION] These terms are governed by the laws of [insert governing law], and disputes will be handled by [insert competent courts or arbitration body]. This provision does not affect consumer protection rights or mandatory legal rights that apply in your location.
17. Additional app-store terms
If you download the app through the Apple App Store, Apple is not a party to these terms and has no obligation to provide maintenance or support for the app. Apple is a third-party beneficiary of these terms. For Apple-related matters, if these terms conflict with Apple’s standard end-user license agreement, Apple’s requirements will control. If you download the app through Google Play, Google Play’s applicable terms also apply.
18. Changes and contact
We may update these terms from time to time. We will notify users of material changes through in-app notices, email or other reasonable means. Continued use of the service after updated terms take effect means you accept the updated terms, to the extent permitted by law.
